Falsely Accused of Owning Child Porn, Toronto Man Sues for $6m.
Friday, May 26th, 2006When you come across an article entitled “Battling False Child Porn Charges??? it’s almost human instinct to think that the accused must of done something wrong to get such heavy charges laid against them.
Apparently that is not so for a 58-year-old Toronto man.
It appears that the only thing that retired dentist Wayne Neville seemed to have done wrong was own a credit card.
From the Toronto Star Article:
“Neville believes police were acting on fraudulent transactions billed to his credit card, which he had reported to the card company. He was issued a new card, but credit card investigators left the old one active in an attempt to trace who was using it. He says he reported the problem and received a new card in September 2001.???
The thieves continued to rack up illegal child porn charges, using his old credit card.
A string of events happened leading up to his eventual 2002 arrest.
His housemate attempted suicide, and the police looked up Neville in the system, and found some reference to child porn in his file. They got a search warrant, arrested him, and confiscated his collection of firearms, which, according to the Toronto Star, “perhaps one of the most extensive and valuable firearms collections in Canada.???
Police charged him with four firearm offenses. The charges were eventually appealed and Neville was given probation. Authorities thought that because the other charges didn’t stick, they didn’t have enough of a case to press on the child porn charges.
March 2004 brought a judgment declaring the search of Neville’s house to have been done under unlawful circumstances. Soon thereafter they tried to revoke Neville’s firearm license. A few days later officer declared that he only saw adult pornography when they searched his house in 2002.
The article goes on describing one after another, obvious violations of an innocent man. The last of which included a battering ram through his front door at 6:20 am in May 2004. The police officers involved were at this point grasping at straws. After the last search of his house, not once piece of child pornography was found on his computer or elsewhere on the premises.
Out of everything I read in the article, this statement hits home for me, and stands out as the number one reason why I think Wayne Neville is innocent:
“In an interview, Neville said he’s a consumer of adult pornography, which he buys locally, and is sickened by child pornography. Instead of verifying the information with the credit card company, Neville alleges police negligently pursued him. He also believes police incorrectly assumed he was downloading material off the Internet. Although he had paid for Internet access in a bundle deal, he used his computer primarily “as a typewriter,” and hadn’t even bothered to hook up his connection.???
Wayne Neville is suing the Toronto and York Region police for 6 million dollars.
And I hope he gets every cent.
